Participant Agreement for Residence Stay

This Participant Agreement (“Agreement”) is between the American Indian Law Center, Inc. (“AILC”) and the undersigned participant (“Participant”) for the purpose of ensuring compliance with the provisions of the Memorandum of Understanding (“MOU”) regarding the Participant's stay in the residence at the University of New Mexico (“UNM”).

WHEREAS, the American Indian Law Center, Inc, under the sponsorship of the UNM School of Law is securing the use of UNM residence facilities for PLSI Participants’ use during the 2025 program dates;

WHEREAS Participant will be lodging in the residence facilities provided by UNM as part of the PLSI;

NOW, THEREFORE, the Participant agrees as follows:

  1. Compliance with Rules, Policies, and Behaviors. Participant shall comply with all University and Residential Life & Student Housing ("RLSH") rules and policies, as well as all State and Federal Laws as detailed in the MOU. Particular emphasis is placed on the Rules, Policies, and Behavior outlined in Attachment 1, which is incorporated herein by reference. Prohibited actions include, but are not limited to, those specified in Attachment 1.
  2. Visitation and Overnight Guests. Participant shall limit visitation in residence halls to PLSI participants and related staff only, with no overnight guests allowed.
  3. Community Area Maintenance. Participant shall keep community areas clean and follow guidelines regarding prohibited items and actions. Participant is responsible for any damages or losses, which will be assessed after check-out.
  4. Right of Entry and Relocation. Participant acknowledges that RLSH reserves the right to enter any lodging accommodations for inspection purposes and may require occupants to relocate if deemed necessary for health or safety purposes.
  5. Responsibility for Damages/Losses. Participant is responsible for any damages or losses they cause to UNM property, facilities, or employees resulting from their actions. Such damages or losses may be assessed after check-out and billed accordingly. If any such damages or losses occur, the AILC may withhold any reimbursements owed to Participant until all charges have been paid by Participant. 
  6. Indemnification. Participant shall indemnify, defend, and hold harmless AILC and UNM, their officers, agents, and employees from and against any and all claims, liabilities, losses, damages, or expenses resulting from Participant's breach of any provision of this Agreement or any negligent or wrongful act or omission by Participant. 
  7. Meal Card.  The AILC is not responsible for replacing lost meal cards or IDs that have meal credits on them.  

Attachment 1 - Rules, Policies, Behavior

The following are prohibited:

  1. Possession of firearms, weapons, ammunition, fireworks, explosives, or highly flammable materials within the residence halls.
  2. Possession of or being under the influence of alcoholic beverages, marijuana, controlled substances, or the possession of drug paraphernalia.
  3. Use of hot plates, candles, or other items with a heating element in the residence halls.
  4. Tampering with or removal of windows or window screens from any part of University property.
  5. Tampering with fire systems, fire-fighting equipment, door alarms, exit signs, or emergency call systems.
  6. Smoking, vaping, or use of any tobacco product within the residence halls.
  7. Removal or relocation of furniture from its permanent location.
  8. Blocking of community area entrances/exits or unlocking/propping open of perimeter doors.
  9. Possession of any animal not pre-approved by RLSH.
  10. Gambling in any form.
  11. Admittance to the dining or lodging facilities of nonparticipants.
  12. Misuse, abuse, theft, or destruction of UNM property.
  13. Behavior dangerous to persons or property.
  14. Threats made in person, by telephone or email or other media to a UNM employee, student, or group participant.
  15. Harassment based on age, ancestry, color, ethnicity, gender, gender identity (including gender expression), genetic information, national origin, physical or mental disability, pregnancy, race, religion, serious medical condition, sex, sexual orientation, spousal affiliation, and veteran status.
  16. Occupation of windowsills, balconies, roofs, or any other external appendage of UNM facilities.

By signing below, the Participant acknowledges that they have read, understood, and agree to abide by the terms and conditions set forth in this Agreement.
